Im Anschluss untersucht er exemplarisch, ob die vor Inkrafttreten der neuen §§ 100a, 100b StPO praktizierte technikoffene Auslegung der vermeintlich einschlägigen Ermächtigungsgrundlagen zur Legitimation von Quellen-TKÜ und Online-Durchsuchung rechtlich zulässig gewesen ist. Ferner prüft er, ob verdeckte personale Ermittlungen im Internet auf Grundlage der ursprünglich für den Einsatz in der „analogen Welt“ verabschiedeten §§ 110a ff. StPO durchführbar sind.
